Intégrité ou intégrisme?

 

J'ai la conviction qu'on ne choisit pas celui qu'on doit aimer. J'imagine qu'il réalise tous les rêves qu'on a pu faire et qu'il ne ressemble à aucun. Il n'est ni beau, ni laid... ni jeune, ni vieux... assez riche pour vous nourrir, assez pauvre pour vous ruiner... C'est l'homme qu'on attendait et qui vous surprend... qui vous met la main dessus, qui vous emporte et vous torture et vous enchante... et qui vous colle dix ans de plus quand il s'en va !

Rumour has it that one of the stumbling blocks to reaching a settlement in the McCartney-Mills divorce is that Sir Paul wants a confidentiality clause that would prohibit his ex-wife from publicizing details of their relationship. Mills could presumably make a few million bucks from a book about their relationship, but I doubt that that is the motivation for her refusal to agree to a confidentiality clause. If he really wants it, McCartney is presumably willing to pay her more for the confidentiality clause than Mills could get from any book deal.

If the value of her silence to McCartney is worth more than the value of her story to a publisher, then perhaps Mills is merely trying to drive a hard bargain by refusing to agree to a confidentiality clause. Perhaps she thinks he will ultimately cave in and offer her a great deal more to get the confidentiality he wants. But isn't that tantamount to blackmail? Why would the Court allow Mills to play that game?

More importantly, the Court should not lose sight of the fact that there is a small child from this marriage. Even in the garden-variety divorces that I deal with in my legal practice, judges admonish the parties that they will have to learn to play nice and get along for the sake of the child. A parent who insults the other parent, even privately, risks incurring the wrath of the judge. If Mills wants to humiliate McCartney by publishing a tell-all book about their relationship, the question the judge should be mulling over is how that plan is going to affect the child in the long run. Will she be ridiculed by her peers as she grows up over the salacious details? Will she be caught between her loyalties to her two publicly warring parents? Nothing good can come of this for the child. What does it say about Mills as a mother that she would want to put her child through this?

The judge should tell McCartney and Mills that under no circumstances will they be permitted to publicize anything derogatory about the other party, on pain of losing custody of the child. That would put an end to Mills' apparent blackmail attempts.
